These Terms and Conditions, together with the information set out on the website form part of your contract with Chris Jones of Celtic Trails 4×4; The trading and contact address is 17 Golwg Yr Eglwys, Pontardulais, Swansea, SA4 8EE.

These Terms and Conditions refer to an adventure described on the Celtic Trails 4×4 website.

BOOKING YOUR ADVENTURE

(a) Bookings can be made:
On the www.celtictrails4x4.co.uk website

Emailing info@celtictrails4x4.co.uk
The booking is only complete once payment is received, and the booking form (either online, PDF or paper) is completed and received by us. Once completed, we will send you a written acknowledgement of the booking and confirmation of the dates and any payments made.
(b) Special Requests
Special requests should be made at the time of booking and specified on the Booking Form. Every effort will be made to accommodate special requests, but we cannot guarantee that they will be, nor will Celtic Trails 4×4 be liable if special requests are not met.
(c) Correspondence and other communications
All correspondence will be sent to the first person named on the Booking Form using the first email address supplied on the booking form unless you specify otherwise.
(d) Passengers who are under 16
If you have passengers who are under 16 then you must contact Celtic Trails 4×4 before making the booking to ensure you are satisfied that the trip is suitable. The decision on suitability is down to you, however, Celtic Trails 4×4 reserve the right to refuse bookings if we determine that the trip is unsuitable for any passengers under the age of 16.

AMENDMENTS & CANCELLATIONS

(a) Amendments by you.
Celtic Trails 4×4 will make every effort to help you if you wish to alter your arrangements. Requests for an amendment must be in writing and either posted to the Celtic Trails 4×4 address on the website or sent using the info@celtictrails4x4.co.uk email address. An administration charge of £20 per person is made to amend your adventure once confirmed, plus any additional costs incurred by the change. Cancellation charges may also apply if changes occur within the designated period. (See tables below.)
(b) Cancellation by you.
All cancellations must be advised in writing, signed by the signatory of the Booking Form and sent by post to Celtic Trails 4×4 using the address on the website, or by email to info@celtictrails4x4.co.uk
Cancellations cannot be processed until the written confirmation is received and are effective on the day of receipt by days prior to the adventure date when written advice of cancellation received as % of adventure price payable.
The following cancellation charges will be payable, depending on the number of days prior to departure when days prior to the departure date when written advice of cancellation received as % of total tour price payable:
UK Adventures:
28 to 14 days prior 30%
less than 14 days 100%
(c) Amendments by Celtic Trails 4×4
Great care is taken to ensure that the descriptions, information and prices given are accurate at the time of publication. Changes can occur and Celtic Trails 4×4 reserves the right to advise you of a change, including a change of price, before accepting your booking.
After booking confirmation, Celtic Trails 4×4 shall make every effort to ensure that the adventures are operated as advertised. In very rare circumstances, Celtic Trails 4×4 may have to modify an adventure before you depart. If the modification is significant (that is, whether it is a change of destination or a change to an alternative date) we will notify you as soon as possible. In this situation, you may accept the modification, or you may change your booking to another adventure at a later date.
This section – Amendments by Celtic Trails 4×4 – does not apply in the case of force majeure. Force Majeure means unusual and unforeseeable circumstances beyond Celtic Trails 4×4 control, the consequences of which neither Celtic Trails 4×4 nor its suppliers or agents could reasonably be expected to avoid, including, but not limited to, war, threat of war, riot, civil strife, terrorist activity (actual or threatened), industrial dispute, technical problems with transport, machinery or equipment, power failure, natural or nuclear disaster, fire, flood, drought, adverse weather conditions and level of water in rivers.
(d) Cancellation by Celtic Trails 4×4
If you fail to pay the balance of the price for your chosen adventure at least 28 days before departure, Celtic Trails 4×4 will treat your booking as cancelled and levy the cancellation charges set out in paragraph 2(b) above.
If Celtic Trails 4×4 is obliged to cancel your adventure in any other circumstances before departure, for example, if insufficient numbers book, we will ensure that you are offered alternative adventure or will ensure that you are given a full and prompt refund.

Insufficient numbers (5 vehicles) are defined as too few bookings being made to make the product viable in the advertised form.

YOUR RESPONSIBILITIES

(a) Currency
All prices and adventure are quoted in Pounds Sterling and include VAT where applicable.
(b) Authority on tour
By submitting the booking form, you agree to abide by the authority and decisions of our staff and adventure leaders throughout the experience. We reserve the right to remove any participant from the adventure if their behavior is deemed by Celtic Trails 4×4 staff to jeopardize the safety or enjoyment of others. In such cases, no refund will be provided.
(c) Acceptance of risk
Your booking is accepted on the condition that:
You are aware of that the product, in addition to the usual dangers and risk inherent with motor-sport activities, has certain additional dangers and risks including, but not limited to: physical exertion for which you may not be prepared, weather extremes subject to sudden and unexpected change, remoteness from the normal medical services and evacuation difficulties if you are disabled.
You acknowledge that the enjoyment and excitement of adventure travel is derived in part from the inherent risks associated with travelling and undertaking activities beyond the levels of safety at home or work and that these inherent risks contribute to such enjoyment and excitement, being a reason for your participation.
You understand that the route, schedules, amenities, accommodation and mode of transport may be altered without notice due to local circumstances or events, such as sickness, mechanical breakdown, blocked routes and other unpredictable or unforeseen circumstances. No refunds will be given for services not utilised. Any additional costs such hotel accommodation will be your responsibility and must be paid for directly at the time.
(d) Passengers under the age of 16
Passengers who travel with you and are under the age of 16 are your sole responsibility for the duration of the adventure. You must make sure they are accompanied and are supervised at all times. Under no circumstances can your passengers under the age of 16 be left alone, in the care of other clients on the adventure or with Celtic Trails 4×4 staff.
(e) You and Your vehicle
All vehicles must be road legal. A valid insurance certificate and MOT test certificate must be held for the vehicle. All drivers must hold a full UK driving licence. Vehicles must comply with the legal requirements for the United Kingdom of Great Britain

IF YOU HAVE A PROBLEM

(a) All of the tours are hosted by staff or employees of Celtic Trails 4×4.
(b) If you are unhappy with any aspect of the arrangements while you are on an adventure, you should address your complaint immediately in the first instance to the Celtic Trails 4×4 representative and, if appropriate, to the management of the hotel or other supplier whose services are involved, so that Celtic Trails 4×4 will have an opportunity to correct the matter during your stay,
(c) Failure to immediately raise the complaint with the Celtic Trails 4×4 representative will mean that any rights you may have will be reduced or even extinguished.
(d) If the problem cannot be resolved locally and you wish to complain, full details must be sent to Celtic Trails 4×4 in writing by Registered Post to arrive within 30 days of your return from your adventure at the address on the www.celtictrails4x4.co.uk website.
This contract and any matters arising from it are governed by the laws of the UK and are subject to the jurisdiction of the Courts of the UK.
